Additional Terms & Information
Damages and Security deposit: The RENTER acknowledges his/her RESPONSIBILITY for the safe and proper operation of the vessel, and for the safety and welfare of other boaters and passengers. It is agreed and understood by the renter that LESSOR shall not be held liable for damages, inconveniences or time lost cost by an accident, breakdown, or malfunction of the vessel. RENTER further agrees to indemnify and hold harmless LESSOR and its agents against any and all claims. RENTER further agrees to hold LESSOR harmless should loss or damage occurs to renter's property while in the rented vessel. Initials: ________ Upon arrival, a security deposit of $500 will be required. This DEPOSIT is held for any damages up to the total value to the boat rented at the time of the rent. Any damages will be billed and added to renter's agreement. The deposit can be a force on a credit card or be held in cash. The security deposit will be returned after the rental vessel is checked over for damage and rental bill is paid. Initials: ________ In Consideration of the agreement herein, SAIL_A_BOAT (Miami design & construction, INC.)(herein after referred to as the LESSOR) agrees to lease to the undersigned (herein after referred to as the RENTER) the boat and equipment required by US Coast Guard (USCG) for operation of the vessel. The RENTER certifies that he/she has examined the vessel and equipment and found it acceptable and suitable for the purpose for which it is rented. That he/she will operate the vessel in accordance with all safety rules and regulations as posted by USCG and as written by manufacturer on the vessel's placard, and further certifies that he/she understands the rules and regulations. Initials:______ The RENTER agrees to report any accident, malfunction or breakdown of rental watercraft to the LESSOR immediately in accordance with the rules. Initials:________ The security deposit in the amount of $500 shall be retained by the LESSOR as partial compensation for failing to return the vessel in the condition it was rented from the LESSOR. The RENTER expressly agrees to indemnify and hold the LESSOR and its agents, affiliates and personnel, harmless of from and against any and all loss, cost, damage, attorney fees and/or liability in connection with the enforcing of the rental agreement, including expenses incurred in connection with attempting to collect delinquent rent and in the event of a suit by LESSOR, to recover possessions of said vessel and/or to enforce any terms, conditions and/or provisions hereof. Initials:______ In the event of malfunction, breakdown the RENTER will immediately report to the LESSOR. Continued use of it shall entirely at the RENTER's risk and thus the RENTER assumes all liability of injury and damage to all persons and property that may become involved by its continued use. Initials:______ The LESSOR reserves the right to cancel this rental due to inclement or impending bad weather. Rental fees will be cancelled proportionally. The RENTER agrees that the LESSOR's vessel will not be occupied by a greater number of persons that is shown on the vessel's placard.
